STOP CRUELTY AND ABUSE TO THE ANIMALS
DEFINATION OF CRUELTY AND ABUSE TO THE ANIMALS –
Basically numberless definations are available on this topic
. But in general , as per , “ INTERNATIONAL
CONVENTION FOR THE PROTECTION OF ANIMALS” we should get it very in very clear
and ultimate structure . Because the ,
“LAWS AND RIGHTS” described by the ---------------------is accepted by all the
countries as per their own demographical distribution and constitution to
secure the life of both stray , wild animals and also human being to keep the
natural ecological balance intact .
These laws and basic rights of animals basically confirms
that , “any kind of wrong and misleading activities , that cause any unnatural
sufferings to the natural standard life of any kind animals like domestic ,
stray and wild –may be treated as “cruelty and abuse to the animals " and all the
ways this is punishable activity as per animal welfare act in any country .
The punishment may be varied from country to country . But
everywhere it will be treated as “ criminal offence “ and the offender would
treated as a “ criminal “ .
Now before we know about the cruelty and abuse to the
animals , better we should know the category of animals , so that we may
realize the importance of animals and their protecting laws , settled by the
Human authority and more strictly about our own role and responsibilities to
them . And for the animal right laws , there are numberless "Animal rights organisations" are working by raising slogans for voiceless , publishing articles on animal rights , making campeign to clear the concept of " animal rights vs human rights " . In most of the developed countries , we now find the trend of "animal welfare zoos" . These are not just to protect the animals , but to create a mass awarness , specially among the next generations . If we think that , to protect the natural ecological ballance , we need to protect the animals and all our efforts would be limited by making slogans for animal rights , writing essays on animal rights , and making some debate , that would be wrong .
Better we should know --------
ANIMAL- Any living being apart from human being and plant ,
with movement ability , is treated as
“Animal” .
WILD ANIMAL – Any animal that lives in own inherited
surroundings with natural food habits and shelter and surely without any human
control , is treated as “ Wild animal “
.
CAPTIVE WILD ANIMAL – THEY ARE ALMOST LIKE WILD ANIMAL , BUT
THE SURROUNDINGS ARE SOMEHOW CONTROLED BY THE HUMAN .
DOMESTIC ANIMAL – They generally live within human
surroundings in a good cared manner .
COMPANION ANIMAL – These animals generally stays with the
human and keep a good contribution to the mankind and to be more specific it is
to the economy . Farm animals may be treated in this category .
Commercial animals – Some animals are directly contributing
to the mankind and they are treated as Commercial animal . They have a standard
lifestyle like any other human citizen . They have their own family , duty ,
salary , designation and also retirement . The Army Dogs , some trained
elephants of forest department are good example of commercial animals .
VICTIMIZED ANIMAL IN SCIENTIFIC RESEARCH ACTIVITY – Many
species are collected and they have to under numberless scientific research
program . In most of the cases , they have to be the victim for the sake of
mankind and face unspeakable pain .
Many animal / social / environmental activists
call this process of victimizing the animals as “ WHITE COLOR CRIME “ .
So
along with the time
and demand , many countries are trying to minimize the number of such animals
in scientific research program and also reduce their pain .
What are animal rights?
Animal rights are moral principles grounded in the belief
that non-human animals deserve the ability to live as they wish, without being
subjected to the desires of human beings. At the core of animal rights is
autonomy, which is another way of saying choice. In many countries, human
rights are enshrined to protect certain freedoms, such as the right to
expression, freedom from torture, and access to democracy. Of course, these
choices are constrained depending on social locations like race, class, and
gender, but generally speaking, human rights safeguard the basic tenets of what
makes human lives worth living. Animal rights aim to do something similar, only
for non-human animals.
Animal rights come into direct opposition with animal exploitation,
which includes animals used by humans for a variety of reasons, be it for food,
as experimental objects, or even pets. Animal rights can also be violated when
it comes to human destruction of animal habitats. This negatively impacts the
ability of animals
Now we should know some very basic activities , those could
be treated as crime under the laws of prevention of cruelty and abuse to the
animals , done by us frequently .
* Depriving from natural food , shelter and other essential items to live a standard life .
* Displacing from natural habitant.
* Buy and sell without legal documents and permission .
* Abandonig and replacing without maintaining proper transportaion laws .
* Engaging into unethical and living killing show like , " Dog fight " , " Cock fight " , racing etc .
*Anykind of overwork and training schedule without proper medical fit certificate , issued by the Vet .
* Any kind of physical and mental torture and forcing the animals to practice something , that is not desired by them .
*Engaging them into unlawful activity .
These are just the basics and the list could be more and more long as per the local laws and in that case people should be more carefull to treat the animals .
And any kind of intentional mal practice with the animal can be treated as criminal offence . The level of punishment would be differed as per the level of the animal . And this process is not just limited within pet and wild animals . Rather in some cases , any kind of neglection , intentional mal practices to the unowned animals , would be treated as more severe criminal offence .
BASIC PATTERN OF ACTIVITIES RELATED TO ANY ANIMAL , THAT CAN
BE TREATED AS “CRUELTY AND ABUSE TO THE ANIMAL “
The vital point is to remember that , in many cases the legal definitions of “cruelty” or “cruel killing” do not always match our own ideas. Generally the laws often do not characterize a quick or “humane” death as animal cruelty, even in cases that seem gruesome and outrageous to us. While each anti-cruelty law characterizes animal cruelty differently, the acts that are typically included are killing, injuring, torturing, neglecting, overworking, and abandoning , displacing , capping and many such activities to an animal.
Killing an animal as an act of cruelty may seem self-explanatory, but there are numerous exceptions. For example, millions of animals are killed in animal shelters each year. Though what these shelters do is not considered animal cruelty under the law . Many organizations and legal body do not support the killing of animals in any circumstance unless they are euthanized because they are terminally ill or untreatably injured.
• Injuring an
animal may also appear self-explanatory, but such acts can be hard to
investigate. Oftentimes, an illegal injury to an animal is only discovered by a
veterinarian who can tell the difference between an accidental and intentional
wound.
• Definitions
of torture also differ significantly.
For example, in Texas, torture includes any act that causes unjustifiable pain
or suffering, while in Utah, torture means intentionally causing or inflicting
extreme physical pain to an animal in an especially heinous, atrocious, cruel,
or exceptionally depraved manner. Utah’s specific standards for what
constitutes ’torture’ make it harder both to prove that torture of an animal
occurred and to punish the perpetrator.
In country like India , where many people lead a life ,
culture and also economy with numberless animals , both the definition of
torture , laws to prevent and it’s practices may be varied from time to time
along geo-economical demography .
• The
definition of neglect in anti-cruelty laws varies. Typically neglect is when a
person who owns or has custody of an animal fails to provide adequate care for
the anima . Anti-cruelty law has a list of neglectful acts that are related to
animal restraint, veterinary care, keeping animals outside, and providing food
or drink.
• Overworking
animals—also referred to as overdriving or overloading—typically refers to the
abuse of and lack of care provided to working animals. When the first
anti-cruelty law was passed in 1866, overworking horses used for transportation
was a major concern of animal advocates.
• Abandonment
generally refers to an owner or custodian leaving the animal without providing
for the animal’s proper care or without making reasonable arrangements for
custody with another person. The purpose is to prohibit people from putting
their pets outdoors permanently when the pets are accustomed to living with and
being cared for by people indoors.
For the sake of both animals and humans, animal cruelty is
unacceptable and cannot be ignored.
The impact of cruelty and abuse to animals like violence on
society
Society must remain vigilant against every act of violence
inflicted on any victim. Animal cruelty should always be investigated,
prosecuted, and penalized to the fullest extent of the law. Anti-cruelty laws
are among many types of laws designed to protect society from violent people.
In fact, anti-cruelty laws, which were first enacted in the late 1800s and
established to protect animals from human violence regardless of ownership, led
to the creation of child abuse laws and then, in the 20th century, elder abuse
laws.
Unfortunately, even in states with robust anti-cruelty laws,
enforcement remains the largest obstacle to reducing animal cruelty. Police
officers and prosecutors sometimes fail to recognize that animal cruelty is a
serious crime that negatively impacts the larger community. Even those who want
to punish offenders may face a lack of evidence to pursue charges.
HOW DOES THE VIOLENCE HUMAN SOCIETY LEAD ANIMALS TO THE VIOLENCE AGAINST ANIMALS ?
Years of extensive scientific research reveals the link
between violence toward animals and violence toward humans – specifically
children, domestic partners, the elderly, and other vulnerable individuals.
For example, according to Frank R. Ascione’s report for the
U.S. Department of Justice, “Animal Abuse and Youth Violence,” animal abuse may
be a result of childhood experiences in nearly two in three violent adult
offenders. There is also evidence to suggest that some animal cruelty offenders
are extending the pattern of violence they see as children. As explained in Dr.
Randall Lockwood’s paper, “Cruelty Towards Cats: Changing Perspectives,” those
who grow up in a household where animals are abused feel safe and in control
“by inflicting pain and suffering on themselves and others.”
There are also studies of domestic violence cases that have
shown a correlation between violence against spouses or partners and violence
against pets. Offenders may abuse a partner’s pet to threaten or control them
or inflict violence on both victims at the same time. For example, in a
six-year study conducted in 11 U.S. metropolitan cities, pet abuse is found to
be one of four predictors of domestic partner violence. Furthermore, in a
national survey of U.S. shelters for victims of domestic violence and child
abuse, 85 percent of women and 63 percent of children who came to the shelter
reported incidents of animal abuse in their homes.
How can we prevent the cruelty and abuse to the animals ?
This is not just an easy task to be done by one single
person in a day . The ways are very open , comfortable and almost easy to do ,
if the joint effort is here and practices are done properly in a regular manner
.
1)Awareness program ---- The first and foremost duty is to
make a common and acceptable awareness program among the common in a regular
way . The program should be conducted regularly as per the geo-economical and
socio-cultural demography . A common point of benefit for both animal and human
, should be focused to attract the people .
2)Communication ---- To make fruitful program with positive
vision , the next step is to build up a good community with various kind of
people to get the problems and their solutions in an adjustable way . There are
several organizations and Governmental departments are also available to work
on the same issue . For prompt action and better solution , each and every
community should be internal linked .
3)Strict observations –Each and every one needs to be good
observer all the ways in a responsive manner . It is not all about laws ,
rather the basic sense of humanity . Each one can set an example . So the
observation is started and treated properly , in a responsive way , there will
be more problems to be discussed and solved In the next stage .
4)Legal action – There are numberless organizations ,
Governmental department , laws and rules . So no one is alone and emotion is
not everything ,too . All the negative issues should be collected in a silent
way and one after one legal action should be taken . In a very simple way , the
wrong doers should be terrified of legal action . And once they will feel that
, there might be someone unknown , who is watching the wrong doings and it may
cause him/her to a judicial process , automatically they will think twice . So
all the ways , there should be one after one strict legal action against the
offenders in a regular way , so that the legal conceptions may be working in
their brain along with the awareness .
